Fieldza by Flintime Inc. ("Fieldza," "we," "us," or "our") provides cloud-based field service management software that helps business customers manage clients, jobs, quotes, invoices, scheduling, dispatching, payments, communications, and related field operations (the "Service"). Fieldza is offered through our the website located at https://fieldza.com and any subdomains thereof (the "Website"), our native mobile application for Apple iOS devices distributed via the Apple App Store ("Fieldza for iOS"), and our native mobile application for Android devices distributed via Google Play ("Fieldza for Android"). The Fieldza for iOS and Fieldza for Android are collectively referred to as the "Apps" or "Mobile Apps." The Website, Apps, and Service are Fieldza products owned and operated by Flintime Inc.. We respect the intellectual property rights of others and expect users of the Website, Fieldza for iOS, Fieldza for Android, and Service to do the same. This Copyright & DMCA Policy explains how we handle claims of copyright infringement under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and other applicable intellectual property laws.
Copyright Infringement Procedure
Fieldza will process and investigate notices of alleged copyright infringement and will take appropriate actions under the DMCA and other applicable intellectual property laws with respect to any alleged or actual infringement.
If you believe that content available on or through the Service infringes a copyright you own or control, you may submit a notification of claimed infringement to our Copyright Agent. To be effective, the notification must be in writing and include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or other intellectual property interest that is allegedly infringed
- Identification of the copyrighted work or other intellectual property that you claim has been infringed, or, if multiple works are covered by a single notification, a representative list of such works
- Identification of the content that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the content on the Service
- Your address, telephone number, and email address
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law
- A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright or intellectual property owner or are authorized to act on the owner's behalf
Counter-Notification
If you believe that content you submitted was removed or disabled as a result of mistake or misidentification, you may send a written counter-notification to our Copyright Agent containing the following:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal courts located in the District of Delaware, and a statement that you will accept service of process from the person who provided the original infringement notification
If a counter-notification is received by our Copyright Agent, Fieldza will send a copy of the counter-notification to the original complaining party informing them that we may replace the removed content or cease disabling it within ten (10) business days. Unless the copyright owner files an action seeking a court order against the user, the removed content may be replaced, or access to it restored, within ten (10) to fourteen (14) business days or more after receipt of the counter-notice, at our sole discretion.
Repeat Infringers
In accordance with the DMCA and other applicable law, Fieldza has adopted a policy of terminating, in appropriate circumstances and at Fieldza's sole discretion, the accounts of users who are deemed to be repeat infringers. Fieldza may also limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
